Terms, Conditions and Waiver

Welcome to Rented Air LLC ("Rented Air," "Company," "we," "our," or "us"). These Terms and Conditions govern your access to and use of the Rented Air mobile application, website, and rental services. By creating an account, reserving, unlocking, or operating any Rented Air vehicle, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

To rent or operate a Rented Air vehicle, you must:

• Be at least 18 years of age
• Possess a valid government-issued photo identification (ID or License)
• Have a valid payment method on file.
• Be physically capable of safely operating the rented vehicle.
• Comply with all applicable federal, state, and local laws.

Rented Air reserves the right to deny service to any individual at its sole discretion.

By using our services, you authorize Rented Air to:

• Verify your payment method.
• Place temporary authorization holds when necessary.
• Charge your account for rental fees, taxes, late fees, damage fees, cleaning fees, parking violations, towing costs, collection costs, and any other applicable charges resulting from your rental.

You agree to maintain a valid payment method throughout your rental period.

Each vehicle is inspected and maintained on a regular basis.

Before beginning your ride, you agree to inspect the vehicle and immediately report any damage or mechanical concerns through the application or customer support.

Operating a vehicle that appears unsafe is strictly prohibited.

The rider agrees to:

• Operate the vehicle responsibly.
• Obey all traffic laws and regulations.
• Yield to pedestrians.
• Ride only where permitted by law.
• Keep both hands on the handlebars whenever practical.
• Never carry passengers.
• Never operate under the influence of alcohol, drugs, or any substance that impairs judgment.
• Never use a mobile phone while operating the vehicle.
• Never tamper with, disable, modify, or attempt to bypass any hardware, software, GPS, IoT, battery system, or security device installed on the vehicle.

The rider assumes full responsibility for all actions while operating the vehicle.

Rented Air strongly recommends that every rider wear a properly fitted helmet and appropriate protective equipment.

Riders should wear:

• Closed-toe shoes
• Comfortable clothing that will not interfere with vehicle operation
• Bright or reflective clothing during low-light conditions

Do not wear:

• Loose scarves or clothing that could become entangled
• High heels
• Flip-flops
• Bare feet

Upon completion of your trip, vehicles must be parked:

• Legally
• Responsibly
• Outside of travel lanes
• Without blocking sidewalks, ramps, entrances, driveways, or emergency access

Improper parking may result in additional fees.

Customers renting vehicles on a daily basis are responsible for safeguarding the vehicle throughout the rental period.

Loss, theft, vandalism, or damage occurring during the rental period remains the responsibility of the renter until the vehicle is returned and inspected by Rented Air.

In the event of an accident, theft, injury, or property damage, the rider agrees to:

• Stop immediately.
• Contact emergency services if necessary.
• Notify Rented Air as soon as reasonably possible.
• Cooperate with any investigation.

Failure to report an incident may result in additional liability.

Operating electric scooters and electric bicycles involves inherent risks, including but not limited to:

• Falls
• Collisions
• Road hazards
• Mechanical failures
• Weather conditions
• Negligence of other individuals

By using our services, you voluntarily assume all risks associated with the operation of 

the rented vehicle.

To the fullest extent permitted by law, Rented Air LLC, its owners, officers, employees, contractors, affiliates, partners, and suppliers shall not be liable for:

• Personal injury
• Death
• Property damage
• Lost wages
• Medical expenses
• Emotional distress
• Loss of data
• Indirect, incidental, consequential, or punitive damages arising from the use of our vehicles or services.

You agree to defend, indemnify, and hold harmless Rented Air LLC and its owners, officers, employees, contractors, affiliates, and partners from any claims, lawsuits, liabilities, damages, losses, fines, penalties, judgments, attorney's fees, and expenses arising from:

• Your use of the service;
• Your violation of these Terms;
• Your negligence or misconduct; or
• Your violation of any law or the rights of another person.

Rented Air utilizes third-party technology providers, including payment processors, GPS systems, mobile applications, cloud hosting, mapping services, IoT platforms, and communication providers.

Although we strive to provide uninterrupted service, we do not guarantee that our application, website, GPS, Bluetooth, cellular connectivity, or vehicle technology will always operate without interruption or error.

Rented Air shall not be liable for outages, software bugs, cyberattacks, communication failures, or technology disruptions beyond our reasonable control.

By checking this box ☐ (In mobile app) you agree to receive text messages from RentedAir about ride alerts, account notifications, and support updates. Message frequency varies. Message and data rates may apply. Reply HELP for help and STOP to opt out. Consent is not a condition of purchase. 

The user enters their mobile phone number and is shown a separate SMS consent checkbox ☐ that is unchecked by default. The user must actively select the checkbox before submitting the registration or verification form.

Your use of our services is also governed by our Privacy Policy, which explains how personal information is collected, stored, and used.

Rented Air reserves the right to suspend or permanently terminate any account for:

• Fraudulent activity
• Abuse of the service
• Dangerous riding
• Tampering with vehicles
• Non-payment
• Violation of these Terms

Termination does not eliminate any outstanding financial obligations.

Rented Air shall not be liable for delays or failure to perform resulting from events beyond its reasonable control, including but not limited to natural disasters, severe weather, acts of government, public emergencies, labor disputes, power outages, internet failures, cyberattacks, supplier interruptions, or other unforeseen events.

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of Rhode Island, or any state in USA without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the use of Rented Air services shall first be addressed through good-faith negotiations.

If the dispute cannot be resolved, it shall be submitted to binding arbitration in the State of Rhode Island, unless prohibited by applicable law. Each party shall bear its own legal costs unless otherwise determined by the arbitrator.

To the extent permitted by law, any legal claim arising from the use of Rented Air services must be filed within one (1) Week after the claim arises. Claims filed after this period are permanently barred.

Rented Air may update these Terms and Conditions at any time. Updated versions become effective upon posting to our website or mobile application. Continued use of our services constitutes acceptance of the revised Terms.

These Terms, together with our Privacy Policy, Safety Policy, Rental Agreement, and any applicable waivers, constitute the entire agreement between you and Rented Air regarding your use of our services.

By creating an account, unlocking a vehicle, or using any Rented Air service, you acknowledge that you have read, understood, and agree to these TERMS and CONDITIONS, Privacy Policy and WAIVER. You further acknowledge that you assume all risks associated with operating the rented vehicle and agree to comply with all applicable laws and Company policies.
